Thomas Pocklington - obtaining money by false pretenses.
From Brisbane Courier Mail - Saturday 9th February 1867
Obtaining Money On False Pretences.
Thomas Pocklington was charged with having obrained 10s. from Henry W. Haseler by means of false pretences.
The prisoner was time-keeper of No. 5 Relief Camp, working in South Brisbane in November last. It was his duty to keep a list of the time each man employed on the camp worked during the week. A man named Michael Cunningham was put down by the prisoner in the pay-sheet as entitled to 15s. for having worked six day, in the week ending the 1st of December, while, according to his own statement, he worked by two days that week, and was only entitled to 5s., which the prisoner gave him on Saturday. From the evidence of Mr. H. W. Haseler, the Government pay-clerk, it appeared that on pay-day, when Cunningham's name was called, the prisoner said that he would take his money and as he had been in the habit of receiving the money for men when they were absent, the 15s. was handed over to him.
The prisoner called several witnesses for the defence, who explained the general method of working at the relief camps, and how the pay was distributed. the prisoner also endeavored to prove that on several occasions irregularities had occurred in the returs, and that some men had been underpaid, while others had received more that the amount due to them.
The prisoner stated in his address to the jury that he had not intended to commit the offence with which he was charged; owing to a mistake in a weekly return, one of the men employed had lost his wages, and he had paid him out of his own pocket; by putting down in his time list that some men had workd longer than they really had, and by then drawing the additional pay, he had only attempted to remunerate himself for money he had expended out of his own pocket.
After a short consultation the jury found the prisoner "Guilty", but recommended him to the mercy of the Court.
His Honor, in sentencing the prisoner to six calendcar months' imprisonment, with hard labor, said that he had taken into consideration the recommendation of the jury, and the fact that the prisoner had been in gaol for two monts before trial.
The Crown Prosecutor withdrew a second charge against the prisoner, of obtaining 5s. by means of false pretences.
